Booking Terms & Conditions



  1. QUOTED PRICES

Quoted prices are valid for 14 days from the date of issue.

 

  1. ACCEPTANCE

2.1. A contract will come into existence between Tipsy Tours Ltd t/a Beyond The Bar and you when you have confirmed by email, post or message that the Quoted Price and/or these Terms and Conditions are agreed or you have paid in full via our online store and accepted the Terms and Conditions or paid the non-refundable deposit or acknowledged and accepted an email with these Terms and Conditions attached, whichever is earliest (the “Contract”).

2.2. In the case of short notice events (less than 14 days from date of the Event) Tipsy Tours Ltd t/a Beyond The Bar reserves the right to proceed on verbal acceptance from you.

2.3. All event details and timings must be confirmed no later than three days prior to the event.

2.4. In accepting these terms you also agree to our Website Terms Of Service

 

  1. BOOKING

3.1 The date, time slot, Beyond The Bar Virtual Experience product name and agreed price for your booking (the “Event”) are stated on your Invoice/ Receipt.

3.1.2 Should guest numbers increase from the initial Quoted Price/ Invoice/ Receipt, we reserve the right to charge a supplement. If the numbers of guests booked should fall, no discount will be given.

3.2 The Event will last 1.5 hours, unless otherwise stated on your Invoice.

 

  1. DELIVERY OF THE EVENT

4.1 All your attendees (“Attendees”) will provide their own ingredients, glassware, cocktail equipment and ice which they will use for the Event, full details of what is required will be sent to the Client (and all attendees if requested) via email prior to the date of the experience.

4.2 Tipsy Tours Ltd t/a Beyond The Bar will provide the meeting link for your virtual Experience unless otherwise agreed.

4.2.2 All Beyond The Bar Virtual Experiences are delivered via Zoom unless otherwise agreed.

4.2.3 All attendees are responsible for their own device being compatible with Zoom and being fully charged or plugged in.

4.2.4 All attendees are fully responsible for having a good connection to the internet during the event.

4.2.5 Every effort to admit latecomers will be made at a suitable time in the event, but admission cannot always be guaranteed.

4.2.5 Tipsy Tours Ltd t/a Beyond The Bar supports drinking responsibly. All attendees must be of legal drinking age in the country where they are attending the Event. We reserve the right to refuse service to anyone for any reason at any time.


  1. DEPOSITS / CANCELLATION

Tipsy Tours Ltd t/a Beyond The Bar will issue an Invoice to you when you confirm your booking or pay in full via our website online store. You agree to pay each invoice submitted by Tipsy Tours Ltd t/a Beyond The Bar as follows, either:

5.1.1 100% on the day of booking the Services or

5.1.2 50% on the day of booking the Services (the “Deposit”) and the remaining 50% (the “Balance”) no later than 14 days preceding the supply of the Event, in accordance with Clause 6 below.

5.1.3 If you cancel within 14 days of the event this will result in loss of booking slot and the Balance of the agreed booking cost.

5.2 The Deposit will be non-refundable however you can select a new date and transfer the Deposit to a new Event which will occur within 6 months of the original Event date. If no date can be agreed, you will be liable to pay the Balance.

5.3. If you fail to make any payment under this Agreement by the date due for payment, then you shall pay interest on the overdue amount at the rate of 5% per annum above the base rate of the Bank of England. Such interest shall accrue on a daily basis from the due date until actual payment of the overdue amount.

5.4 Tipsy Tours Ltd t/a Beyond The Bar reserves the right to modify or cancel the Event without prior notice if unforeseen circumstances arise. In the unlikely event of cancellation of the Event, we shall inform you as soon as possible using the contact details provided to us and offer you a full refund of the experience.

 

  1. CREDIT AGREEMENT

Should you require a credit agreement for your event(s) this must be agreed prior to the event in writing. A credit check will be carried out on all companies who apply for credit. We do not accept credit applications from private clients or sole traders.

 

  1. YOUR RESPONSIBILITIES

7.1. You confirm and warrant that:

7.1.1. the details and terms of the Event are complete and accurate, and you will pay in accordance with the price and payment conditions of these Terms and Conditions;

7.2. If Tipsy Tours Ltd t/a Beyond The Bar’s performance of any of its obligations under the Contract is prevented or delayed by any act or omission by you or failure by you to perform any relevant obligation (Client Default):

7.2.1. Without limiting or affecting any other right or remedy available to it, Tipsy Tours Ltd t/a Beyond The Bar shall have the right to suspend performance of the services until you remedy the Client Default, and to rely on the Client Default to relieve it from the performance of any of its obligations in each case to the extent the Client Default prevents or delays Tipsy Tours Ltd t/a Beyond The Bar’ performance of any of its obligations;

7.2.2. Tipsy Tours Ltd t/a Beyond The Bar shall not be liable for any costs or losses sustained or incurred by you arising directly or indirectly from Tipsy Tours Ltd t/a Beyond The Bar’s failure or delay to perform any of its obligations as set out in this clause 7.2.

 

  1. INDEMNITY

You will be responsible for and will indemnify Tipsy Tours Ltd t/a Beyond The Bar fully against any and all claims, costs, loss, damages or liability arising due to any negligent act or default by you (whether directly or indirectly) or by any person or attendee for whom you are responsible.

 

  1. FORCE MAJEURE

No liability is accepted for failure of performance due to strike, lockout, accidents, fire, floods, ice, obstruction or other such events beyond the control of Tipsy Tours Ltd t/a Beyond The Bar.


  1. LIMITATIONS OF LIABILITY

10.1. Tipsy Tours Ltd t/a Beyond The Bar shall not be liable to you, whether in Contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with the Contract for: loss of profits; loss of sales or business; loss of agreements or Contracts; loss of anticipated savings; loss of or damage to goodwill; and any indirect or consequential loss.

10.2. Tipsy Tours Ltd t/a Beyond The Bar’ total liability to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with the Contract shall be limited to the total amount paid to Tipsy Tours Ltd t/a Beyond The Bar as the time of a claim by you.

10.3. The terms implied by section 3 to 5 of the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from the Contract.

10.4. This clause 10 shall survive termination.

 

  1. STARTENDERS

Bookings are for 1.5 hours. Should we be asked to extend the working hours agreed of the Event, additional hours will be charged at a rate quoted by Tipsy Tours Ltd t/a Beyond The Bar and shall be payable in accordance with clause 5.

 

  1. PROHIBITED CONDUCT

12.1 Limitations on Use. By registering for a Tipsy Tours Ltd t/a Beyond The Bar Virtual Event you and your attendees agree not to sell, trade, transfer or share your access link and/or code. If Tipsy Tours Ltd t/a Beyond The Bar determines that you have violated this policy, Tipsy Tours Ltd t/a Beyond The Bar may cancel your access, retain any payments made by you, report you to law enforcement authorities, and ban you from future Events.

12.2 Disruptive Conduct. You acknowledge and agree that Tipsy Tours Ltd t/a Beyond The Bar reserves the right to remove any attendee from the Event if Tipsy Tours Ltd t/a Beyond The Bar, in its sole discretion, determines that their participation or behaviour creates a disruption or hinders the Event or the enjoyment of the Event content for other attendees.

12.3 Recording, Live Streaming, and Videotaping. Attendees may not record or broadcast audio or video of sessions at Tipsy Tours Ltd t/a Beyond The Bar Virtual Events.

12.4 Unethical/Non-Compliant Business Practices. Tipsy Tours Ltd t/a Beyond The Bar reserves the right to deny participation to anyone who engages in or is reputed to engage in unethical or non-compliant business practices.

 

  1. INTELLECTUAL PROPERTY

13.1 The format and content of every Beyond The Bar Event is protected by copyright and we reserve all rights in relation to our copyright whether owned or licensed to us and all rights are reserved to any of our registered and unregistered trademarks (whether owned or licensed to us) which appear during the Event.

13.2 The Event may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose and you may not systematically extract and/or re-utilise parts of the contents without our express written consent.


  1. NO PARTNERSHIP OR AGENCY

Nothing in these Terms and Conditions is intended to or shall be deemed to establish any partnership or joint venture between you and Tipsy Tours Ltd t/a Beyond The Bar.

 

  1. THIRD PARTIES

A person who is not a party to these Terms and Conditions shall not have any rights to enforce its terms.

 

  1. VARIATION

Except as set out in these conditions, no variation of this Agreement, including the Booking or these Terms and Conditions, shall be effective unless it is agreed in writing and signed by Tipsy Tours Ltd t/a Beyond The Bar.

 

  1. SEVERANCE

If any provision or part-provision of the Contract is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of the Contract.

 

  1. ENTIRE AGREEMENT

18.1. The Contract constitutes the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

18.2. Each party acknowledges that in entering into the Contract it does not rely on, and shall have no remedies in respect of any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in the Contract. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in the Contract.

18.3. Nothing in this clause shall limit or exclude any liability for fraud.

 

  1. LAW OF CONTRACT

You shall comply with all foreign and local laws and regulations which apply to your use of our services in whatever country you are physically located. The Contract and any dispute or claim (including non-Contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the laws of England and Wales.

 

  1. JURISDICTION
Each party irrevocably agrees that the English courts shall have exclusive jurisdiction to settle any dispute or claim (including non-Contractual disputes or claims) arising out of or in connection with the Contract or its subject matter or formation.
